General Power of Attorney

A General Power of Attorney, also known as a Durable Power Attorney, is a legal document that becomes very important if you are not physically present or rendered incapable of handling your own affairs.  This can result from being out of town or due to illness, accident or injury.

When you execute a financial durable power of attorney, you authorize another person to act for you in the event you are incapacitated in all financial matters large and small.  This covers activities from writing checks to paying your bills to engaging legal action on your behalf.

Any failure to sign a properly prepared durable power of attorney will force a court that has little or no knowledge of your situation or your wishes to appoint a guardian (or “Curator”) for you if you can’t handle your affairs for yourself for as long as your incapacity continues.

This stresses the need to have a durable power of attorney in place as it will give you more control over who handles your affairs if you are unable to fulfill your obligations.
